2. Purpose
These Terms of Sale set out the rights and obligations of the parties in connection with the online sale of the products offered by Miloubo to consumers within the meaning of applicable provincial consumer protection laws. They apply to the exclusion of any other conditions and prevail over any conflicting document. The version that applies is the one in force on the day of the order.
3. Products
The essential characteristics of the products are presented on each product page. The photographs are as faithful as possible but cannot constitute a contractual commitment as to colour shades or exact dimensions. Offers are valid while stocks last.
4. Prices
Prices are shown in euros. Applicable taxes are added where applicable. Delivery fees, if any, are shown before the order is finally confirmed. Miloubo reserves the right to change its prices at any time; products are invoiced at the price in force at the time the order is recorded.
5. Ordering
The ordering process includes a summary that lets you check the details and the total price, and correct any errors before you confirm. Payment validation constitutes conclusion of the contract. A confirmation email summarizing the order is sent to you.
6. Payment
Payment is due immediately when you order, by the means offered at checkout. Transactions are secured by our payment provider; Miloubo never has access to your full bank details.
7. Delivery
Countries served: the United States, Canada, the United Kingdom, France, Belgium, Luxembourg and Switzerland. Times by country and fees are set out in the Shipping Policy, which forms an integral part of these terms. No other destination is served. In accordance with applicable consumer protection laws, delivery takes place no later than 30 days after the contract is made.
In accordance with applicable consumer protection laws, the risk of loss of or damage to the products passes to the customer when the customer, or a third party designated by them, takes physical possession of the parcel.
8. Right to cancel and 30-day guarantee
In addition to your rights under the consumer protection laws of your province or territory, Miloubo offers a 30-day money-back guarantee from receipt, without any reason needing to be given. Detailed terms and return form: Refund Policy.
The refund is made no later than 14 days after we have been informed of your decision to return the item, to the original payment method and free of charge. It may be delayed until we have received the product back or you provide proof that you have sent it.
9. Legal guarantees
Independently of any commercial guarantee, the seller remains bound by:
- the legal warranties provided by the consumer protection laws that apply to you – honoured by Miloubo for 2 years from delivery; a defect appearing within 24 months is presumed to have existed at delivery;
- the protection against hidden defects as provided by applicable civil or common law, for 2 years from discovery of the defect.
These guarantees are exercised free of charge by contacting contact@miloubo.com.
10. Personal data
The data controller is CEDARLINE BRANDS LLC, which operates the Miloubo brand. Processing is carried out, depending on the case, to perform the contract, to comply with a legal obligation, with your consent or for our legitimate business interests. Under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, you may have the rights of access, correction and withdrawal of consent, which you can exercise at contact@miloubo.com. Full details: Privacy Policy.
11. Cookies
The site places cookies that are strictly necessary for its operation (cart, session, security), which do not require your consent. Audience measurement and advertising cookies are only placed after your consent, collected through the banner displayed on your first visit; you can withdraw it at any time. The retention period of non-essential cookies and of your consent does not exceed 13 months.
12. Intellectual property
All elements of the site – texts, visuals, logo, trademarks, layout – are protected by Canadian and international copyright, trademark and other intellectual property laws. Any unauthorized reproduction or performance constitutes infringement.
13. Liability and force majeure
Miloubo cannot be held liable for a failure caused by an event of force majeure (carrier strikes, exceptional weather, customs blockages, etc.).
Otherwise, the seller's liability is assessed under general law. No limitation of liability applies in cases of gross negligence or wilful misconduct, personal injury, or where the law prohibits it – in particular in respect of the legal guarantees, which cannot be waived (applicable consumer protection laws).
14. Complaints, mediation and disputes
Any complaint must first be sent to contact@miloubo.com. If no amicable solution is found within 2 months, you may contact your provincial or territorial consumer protection office (see the Office of Consumer Affairs for contacts).
These Terms of Sale are governed by French law, without prejudice to the mandatory consumer protection rights you have under the consumer protection laws of your province or territory of residence. Failing an amicable agreement, the dispute will be brought before the competent courts; the consumer may bring the matter, at their choice, before the courts of their place of residence or those of the seller's registered office.
15. Toy safety and recommended age
The products sold on this site are toys intended for children. They comply with European Directive 2009/48/EC on toy safety and with the harmonized standard EN 71 (parts 1, 2 and 3: mechanical properties, flammability, migration of certain elements).
Each product page states a recommended age. This age is not indicative: it results from the product's safety assessment. Items containing small detachable parts carry the warning "not suitable for children under 36 months – choking hazard".
Use must be supervised by an adult. Packaging, bags and protective films must be removed and kept out of children's reach before first use. Furniture products (learning tower, motor-skills sets) must be fully assembled according to the instructions, on a level floor, and their hardware must be re-tightened periodically.
A toy with a safety defect must stop being used immediately and be reported to us at contact@miloubo.com. We replace it or refund it in full, with return costs at our expense, and, where applicable, notify the competent authorities, such as Health Canada, in accordance with applicable law.
